Is the price of novelties determined by law? Caution is needed regarding the Prize Display Law.
This article explains the laws regarding the pricing of novelties. If you are considering creating novelties, please use this as a reference.
- The price of novelties is determined by the Prize Offering Law! A novelty refers to goods distributed free of charge as part of advertising and promotional activities. On the other hand, when distributing them, they must be produced within the amount specified by the Prize Offering Law. The Prize Offering Law is a regulation that requires truthful representation when providing prizes and gifts from the perspective of consumer protection. Since novelties are distributed free of charge, if expensive novelties are produced, many people will gather. In other words, if a novelty is produced at too high a price, it may lead to irrational product selection. If such a situation were allowed to occur freely, it could potentially disadvantage consumers, which is why the Prize Offering Law sets a price ceiling. - Novelties fall under the category of total gifts according to the Prize Offering Law. The price ceiling for novelties as determined by total gifts is as follows: If the amount paid by the customer is less than 1,000 yen, the maximum value of the prize is 200 yen. If the amount paid by the customer is 1,000 yen or more, the maximum value of the prize is 20% of the payment amount, or 100 yen as a general rule if there is no payment.
